Welcome to Indie4tune Software. By downloading, installing, or using our applications, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of all Indie4tune Software applications, including but not limited to:

• Audiobook Converter Pro (Windows and macOS)
• ChapterForge (Windows)
• ChapterSplit (Windows)

By accessing or using our software, you agree to comply with these Terms and all applicable laws and regulations.

2. License Grant

Subject to your compliance with these Terms, Indie4tune Software grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our applications for personal, non-commercial use.

2.1 Restrictions

You may not:

• Modify, adapt, translate, or create derivative works of the software
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any proprietary notices or labels
• Use the software for any illegal or unauthorized purpose
• Distribute, sublicense, rent, lease, or lend the software

3. Purchases and Payments

3.1 App Store Purchases

Our applications are distributed through official platform stores:

• Windows applications: Microsoft Store
• macOS applications: Mac App Store

All purchases, subscriptions, and in-app purchases are processed through these platforms. By making a purchase, you agree to the terms and conditions of the respective platform:

• Microsoft Services Agreement
• Apple Media Services Terms and Conditions

3.2 Pricing

Our applications may offer:

• Free versions: Basic functionality with optional upgrades
• One time purchases: Lifetime access to premium features
• In app purchases: Additional features or functionality

Prices are set by Indie4tune Software but may be subject to regional variations and currency conversion by the platform stores. All prices are in USD unless otherwise stated.

3.3 Payment Processing

All payment processing is handled exclusively by Microsoft Store or Mac App Store. Indie4tune Software does not directly process payments or store your payment information.

4. Refunds and Cancellations

4.1 Microsoft Store (Windows Apps)

Refunds for Windows applications are subject to Microsoft Store refund policies. Generally:

• You can request a refund within 14 days of purchase
• The app must not have been extensively used
• Refund requests are submitted through your Microsoft account

4.2 Mac App Store (macOS Apps)

Refunds for macOS applications are subject to Apples refund policies. To request a refund:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Select the purchase and request a refund
• Refund decisions are made by Apple on a case-by-case basis

4.3 Direct Support

While refunds are processed through the respective app stores, if you experience technical issues or are dissatisfied with our software, please contact us at indie4tune@gmail.com before requesting a refund. We are committed to resolving issues and ensuring customer satisfaction.

5. Free Trials and Demonstrations

Some applications may offer free trials or limited functionality versions. These trials:

• Are provided for evaluation purposes only
• May have time limitations or feature restrictions
• Automatically expire without requiring cancellation (unless converted to paid)
• May be subject to availability and may be modified or discontinued at any time

6. Privacy and Data Collection

Our applications are designed with privacy as a core principle. Please review our Privacy Policy for detailed information about how we handle your data.

Key privacy principles:

• Local processing: All audio file processing happens on your device
• No uploads: Your audio files are never uploaded to our servers
• No tracking: We do not collect usage telemetry or personal information
• Your content stays yours: You retain full ownership of all files processed

7. Intellectual Property Rights

7.1 Your Content

You retain all rights to any audio files, content, or data that you process using our applications. We claim no ownership over your content.

7.2 Our Software

All intellectual property rights in our applications, including but not limited to software code, design, graphics, logos, and documentation, are owned by Indie4tune Software and protected by copyright, trademark, and other intellectual property laws.

7.3 Third-Party Components

Our applications may utilize third party open source components (such as FFmpeg). These components are licensed under their respective open source licenses. You agree to comply with these licenses when using our software.

8. Acceptable Use

You agree to use our applications only for lawful purposes. You must not use our software to:

• Process copyrighted content without proper authorization
• Violate any applicable local, state, national, or international law
• Infringe upon or violate the rights of others
• Circumvent DRM (Digital Rights Management) protections
• Engage in any conduct that restricts or inhibits others from using the software

Note on DRM: Our applications are designed to convert and process your legally owned audio content. You are responsible for ensuring you have the right to process any content you use with our software. We do not provide tools to remove DRM protection.

9. Updates and Modifications

We may update our applications from time to time to:

• Add new features or functionality
• Improve performance and stability
• Fix bugs and security vulnerabilities
• Ensure compatibility with new operating system versions

Updates may be delivered automatically through the Microsoft Store or Mac App Store. We recommend keeping your applications up to date for the best experience and security.

10. Disclaimer of Warranties

OUR APPLICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, INDIE4TUNE SOFTWARE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that the software will be uninterrupted, error free, or secure
• Warranties regarding the accuracy or reliability of results

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INDIE4TUNE SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use our applications
• Any unauthorized access to or use of your data
• Any bugs, viruses, or harmful code transmitted through our software
• Any errors or omissions in the software
• Loss or corruption of audio files or data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

Important: We strongly recommend maintaining backups of your important files before processing them with any software.

12. Indemnification

You agree to indemnify, defend, and hold harmless Indie4tune Software, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys fees, arising out of or in any way connected with:

• Your access to or use of our applications
• Your violation of these Terms
• Your violation of any third party rights, including copyright or privacy rights

13. Geographic Restrictions

Our applications are available through the Microsoft Store and Mac App Store in regions where these platforms operate. Availability may vary by country or region. We make no representation that our software is appropriate or available for use in all locations.

14. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You may not download or use our software if you are located in a country or region subject to trade embargoes or other restrictions.

15. Termination

We reserve the right to suspend or terminate your access to our applications at any time, without notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of our software or support services

Upon termination, you must cease all use of our applications and may be required to uninstall the software from your devices.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify users through the app store or within the application when feasible
• Post the updated Terms on our website at indie4tune.com/terms

Your continued use of our applications after any changes constitute acceptance of the new Terms. If you do not agree to the updated Terms, you should discontinue use of our software.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our applications shall be resolved through:

• Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with New Zealand law
• Class action waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class actions

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Indie4tune Software regarding our applications.
